Bicycles and Motorcycles

Bicycle retailers and manufacturers may be liable under state product liability law when there is a defect in the design or manufacture of the bicycle, or improper construction or building of the bike.  Bicycle retailers and manufacturers can be liable for injuries if quick-release hubs on the front wheels of bicycles, which allow a bike's front wheel to be removed for easy transportation, are not properly tightened at the time of sale, or are not properly designed by the bicycle manufacturer with safety devices to prevent sudden disengagement.    Bicyclists who have had the front wheel come off can fall forward or over the front handlebars and be severely injured.  The bicycle retailer and manufacturer can be liable under strict products liability and for negligence when such injuries occur.

Motorcycle manufacturers and retailers can be liable for injuries caused by fuel line design and manufacturing defects, which have resulted in fires and explosions; tire defects, resulting in stability loss and crash of the motorcycle; and handlebar defects, which result loss of bike control at high speeds.

If we determine that a bicycle and motorcycle retailer or manufacturer was aware of a design or manufacturing defect that has resulted in severe injury or death to our client, we may seek punitive damages to punish the wrongdoer for such misconduct.

If you or someone you know has been injured by a defective bicycle or motorcycle call Hurley McKenna & Mertz at 312-553-4900 to discuss your rights.
